§ 78-34. Violations of article.

  • A violation of any of the provisions of this article or other regulations made under the authority of the city is hereby declared to be a nuisance per se, and the city, through its qualified officers as provided for by statute for maintaining suits, may institute proceedings in a court of appropriate jurisdiction for the purpose of restraining any violation of any of the provisions of this article. The city council, or any court having jurisdiction, shall order such nuisance abated and the owner or agent, in charge of such building or land, shall be adjudged guilty of maintaining a nuisance per se.
